PUPPY CONTRACT AND WARRANTY INFORMATION

GUARANTEED REGISTRATION:  

Seller certifies that this puppy, is a purebred quality.  Breeder has in hand AKC Registration Papers.  AKC Registration can be completed by pamphlet in pup packet or online.  Pup must receive last name of Z Schutz (Kennel Name) on registration.  Pup will have FULL REGISTRATION… unless other terms have been discussed. This pup is being sold as a pet/potential working dog.

HEALTH GUARANTEE:

Seller certifies that this puppy is, to the best of his/her knowledge, healthy at the time of sale.  General information will be provided verbally by seller, in which includes information on diet, shots, worming, bathing, and any other treatments given this dog at the time of sale.  Both parents are CERTIFIED GOOD on HIPS/ELBOWS. Your pup is guaranteed to be free of crippling hip dysplasia for 25 MONTHS from the date of birth.

The buyer is encouraged to have this puppy examined by a state licensed veterinarian within 10 days of purchase, at the buyer’s expense.  If puppy is diagnosed with a genetic disorder which is attested by two unassociated veterinarians, thereby causing Buyer and Seller to agree that the said puppy cannot live a comfortable lifestyle. Seller will, upon provision of veterinary reports and a spay/neuter certificate, offer a replacement puppy out of the next available litter.. Buyer however must pay any shipping or miscellaneous charges associated with the transport of the replacement puppy.  Seller shall not be held responsible for the development of the non-genetically derived faults, diseases, or disorders, which are due to Buyer’s negligence and/or abuse.

Please note that any form of the mange or skin disorder is an excluded liability of the seller.

ADDITIONAL PROVISIONS AND TERMS OF SALE:

A)     Buyer agrees to provide for the dog’s emotional and physical care, including annual physical examinations and recommended vaccinations by a licensed veterinarian; nutritious food, etc.

B)     Seller strongly recommends that Buyer attend obedience classes with puppy and provide proper socialization opportunities for puppy.  Seller shall not be held responsible for the actions of a puppy that are due to the Buyer’s negligence.

C)     Seller recommends neutering (males) and spaying (females) at the age of 15 months, unless dog is to be bred or is intended for breeding purposes. Please check with your vet on the maturity of your pup for age appropriate spay and neuter. Altered dogs typically live a healthier life and generally have fewer behavioral problems.

D)     Buyer agrees to inform the seller if the buyer intends to sale or transfer ownership to a third party.  FIRST OPTION to resume full ownership must be given to the seller at a price and/or with terms mutually agreed upon by both parties.  This would take into consideration the costs incurred by the breeder in caring for the dog and locating a new home.  The dog will be returned with the registration papers and any medical records.  The seller has ten (10) days to accept or reject this right of first-offer.  If this dog should, anytime in its lifetime, need to be surrendered at no cost, the buyer will reclaim this dog and its disposition becomes the choice of the breeder/seller.  Under no circumstances is the dog to be placed in a pet shop, animal shelter, dog sanctuary or any similar establishment. Under no circumstances is the dog to be used in dog fighting or similar activities.

E)     Buyer agrees that this dog, if used for breeding will not perform any breeding activities until proper health tests have been performed and said dog has reached the maturity age of a minimum of 24 months. Standard health testing includes OFA’s and Brucellosis testing on both breeding parties.  Buyer agrees to get a clearing from veterinarian that said dog is in good health for breeding and is clear of any disease as well as a passing score on OFA's. 

F)   Should the buyer be unable or unwilling to fulfill any of the above provisions, or if this dog is seized by any local authority as having been neglected or abandoned, the seller retains the right to reclaim this dog without compensation.  The buyer agrees to pay the seller any and all expenses, including court costs and reasonable attorney fees, in enforcing the terms and provisions of this contract.  Canines are livestock and therefore cannot be returned for any reason other than those stipulated in the Health agreement or additional terms and provisions sections of this contract.  ALL SALES ARE FINAL.
